Avon and Somerset Police has passed a file on the investigation into an incident in Bristol involving Ben Stokes to the Crown Prosecution Service for advice on charging.
The England cricketer, 26, was arrested on suspicion of causing actual bodily harm on September 25 and released without charge, pending further investigation.
In its statement, Avon and Somerset police said: "A 27-year-old man suffered a fractured eye socket in the incident on Queens Road, Clifton.
"A 26-year-old man was arrested on suspicion of causing actual bodily harm and was later released under investigation.
"We have passed a file to the Crown Prosecution Service and are now seeking charging advice."
Stokes, who is suspended from playing for England by the England and Wales Cricket Board, is currently in New Zealand after flying to Christchurch to see his extended family.
The ECB is set to conduct its own disciplinary enquiry once the police investigation is concluded.
